Withdrawal from the contract
A Consumer and a Sole Trader with Consumer Rights may withdraw from a Contract concluded in the Shop within 14 days of the day on which they acquired physical possession of the Goods, without giving any reason. All that is needed is to send a notice before that period expires: by email, by letter or via the form on the Shop website. The Seller refunds all payments, including the delivery cost up to the amount of the least expensive standard delivery method offered in the Shop, without undue delay and at the latest within 14 days of receiving the notice (the Seller may withhold the refund until it has received the Goods back or evidence of their having been sent back, whichever is the earlier). The cost of returning the Goods is borne by the Customer. For a machine shipped on a pallet, the Seller estimates it at a maximum of approximately PLN 2,100 (including VAT) for each machine - this is what returning the largest machine in the range may cost. Returning smaller machines and lighter Goods shipped by courier costs less.
Example: if the Customer received the machine on 5 November 2026, the withdrawal period expires at the end of 19 November 2026. A notice sent on that day is submitted in time.
Legal basis: Article 7aa and Articles 27-38 of the Polish Consumer Rights Act of 30 May 2014 (Dz.U. 2026 poz. 1244). Capitalised terms (e.g. Customer, Goods, Contract, Order) have the meaning given to them in the Shop's Terms and Conditions (link in the Shop footer).
Who has the right to withdraw from the Contract
- Consumer - a natural person who concludes a Contract with the Seller that is not directly connected with their business or professional activity (Article 22¹ of the Civil Code).
- Sole Trader with Consumer Rights - a natural person who concludes a Contract directly connected with their business activity, where the content of the Contract shows that it is not of a professional nature for that person, such professional nature resulting in particular from the subject of their business activity entered in CEIDG (Article 7aa(1) of the Consumer Rights Act).
If the Contract does not show whether it is of a professional nature, a Customer who is a natural person carrying on a business may declare, at the latest when concluding the Contract, whether it is of such a nature for them (Article 7aa(2) of the Consumer Rights Act). The Seller does not make the conclusion of the Contract conditional on such a declaration being made.
A Business Customer, i.e. a Customer who is neither a Consumer nor a Sole Trader with Consumer Rights (e.g. a company or a person carrying on a business for whom the Contract is of a professional nature), does not have a statutory right to withdraw from a Contract concluded at a distance. Their rights in the event of a defect in the Goods are described on the Complaints and warranty page (link in the Shop footer).
Instructions on the right of withdrawal
These instructions apply to a Consumer and a Sole Trader with Consumer Rights. They have been drawn up in accordance with the model set out in Annex 1 to the Consumer Rights Act.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you have bought, in one order, multiple goods which are delivered separately, or the goods are delivered in multiple lots or pieces, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good, lot or piece.
To exercise the right of withdrawal, you must inform us (SWEPCORE PIOTR WOJTKIEWICZ, ul. Przedwiośnie 4F, 73-110 Grzędzice, Poland, tel. +48 733 770 476, email: biuro.swepcore@gmail.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email).
You may use the model withdrawal form at the end of this page, but it is not obligatory.
You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website swepcore.com (the ‘Withdraw from the contract’ button in the Shop footer; the form does not require logging in and asks, among other things, for the order number and email address). If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (by email) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at the following address: SWEPCORE PIOTR WOJTKIEWICZ, ul. Przedwiośnie 4F, 73-110 Grzędzice, Poland, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods. The cost is estimated at a maximum of approximately PLN 2,100 (including VAT) for each machine returned by pallet shipment. This is what it may cost to return the largest machine in our range from the most distant location in Poland, together with the pallet and shipment insurance - machines shipped on a pallet cannot, by their nature, normally be returned by post. Returning smaller machines costs less, and lighter goods shipped by courier can be returned by standard courier parcel.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Refunds in practice
- Payment by bank transfer (prepayment) - the Seller refunds the money by bank transfer to the bank account from which the payment was made.
- Online payment through the payment provider Mollie B.V. - the refund is made to the Customer using the same method they used to pay, via that provider.
- The refund is made in the Order currency (PLN, EUR or GBP).
The available payment methods and delivery methods are described on the Delivery and payment page (link in the Shop footer).
Returning the Goods in practice
- Before sending a pallet shipment, please send us a short message to biuro.swepcore@gmail.com or call us on +48 733 770 476, so that we can prepare to receive the shipment. This is not a condition for effective withdrawal from the Contract or for a refund.
- On request, we will provide an approximate cost of returning a specific machine on a pallet.
- The Goods should be secured for transport so that they are not damaged. The original packaging is not a condition for the return.
- It is advisable to enclose the Order number with the shipment and to keep the proof of posting. Sending the Seller the proof of posting allows the money to be refunded without waiting for the Goods to reach the Seller.
Checking the Goods and diminished value
The Customer may unpack the Goods and check them to the extent necessary to establish their nature, characteristics and functioning: inspect them, compare the contents of the set with the description on the product page, start the machine and check that its functions work (e.g. drive, brush rotation, suction, controls), just as could be done when inspecting them in a bricks-and-mortar shop. Unpacking the Goods does not take away the right to withdraw from the Contract.
Use beyond this extent is, for example, using the machine for cleaning (washing, scrubbing, vacuuming or sweeping surfaces), after which the tanks, brushes, pads or filters are dirty. The Customer can still withdraw from the Contract in that case, but is liable for the diminished value of the Goods resulting from such use (Article 34(4) of the Consumer Rights Act).
When the right of withdrawal does not apply
Article 38(1) of the Consumer Rights Act excludes the right of withdrawal, among other things, for a Contract whose subject matter is:
- Goods that are not prefabricated and are made to the Customer's specifications or intended to satisfy the Customer's individualised needs (point 3),
- Goods which, after delivery, by their nature become inseparably mixed with other items (point 6).
The machines in the Shop's range are standard Goods, so as a rule these exceptions do not apply to them. Should an exception apply to specific Goods, this will be stated for those Goods before the Order is placed.
Model withdrawal form
